The type of Judges is the result of the political system. In the US each political party tries to load the justice system with judges sympathetic to the party's ideology. At certain times one party might find itself in an advantageous position.
To draw from what occurred in the Weimar Republic is superficial. In Germany, power was given to Hitler which eventually led to the amendment of the constitution. This made it much easier for Hitler to destroy the communists who were a major obstacle to his efforts to garner totalitarian trappings. |
What is required is serious look at the system of selecting and retention of judges in the US.
For start: Should a supreme justice have life tenure? A stretch to Weimar is one of drama; the US has its own particular history of politically appointed and elected judges. |
Lifetime tenure has become a mistake. Just like no term limits on federal legislators.
