“The process was that the laptop was left by Hunter Biden, in an inebriated… heavily inebriated state with the merchant,” claimed Giuliani on the show. “The merchant fixed the laptop, tried to reach Hunter Biden and Hunter Biden never came back for it.”

“The document that I have signed by Hunter Biden says that after 90 days the hard drive is abandoned and it becomes the property of the merchant. Sometime after it became his property, he became very suspicious that maybe he had evidence of a crime sitting in his office,” he went on. “So he listened to it and he found that he did.”

Giuliani declared, “He had legal possession of it. He legally turned it over to the FBI, and then he legally turned it over to my lawyer. It’s now his property. He can do what he wants with it.

Now, why are they so sensitive about this? When they were more than willing to publish stolen tax returns — not legally obtained — stolen tax returns on the President of the United States.”

“They say it was hacked. It hasn’t been hacked. He never even bothered to find out if it was hacked,” he added.

Are there errors in the New York Post report?

A separate article, about another email, claims that a public relations company that worked for Burisma was allowed to take part in a conference call about an upcoming visit by Joe Biden to Ukraine. But there was nothing secret about this call, and the transcript was released publicly and posted on the White House website.

More broadly, the New York Post repeats the falsehood, advanced by Trump, that the “elder Biden pressured government officials in Ukraine into firing a prosecutor who was investigating the company.”

We have fact-checked this repeatedly. During President Barack Obama’s second term, Biden was in charge of the Ukraine portfolio, keeping in close touch with the country’s president, Petro Poroshenko. Biden’s brief was to sweet-talk and jawbone Poroshenko into making reforms that Ukraine’s Western benefactors wanted to see as part of Ukraine’s escape from Russia’s orbit. But the Americans saw an obstacle to reform in Viktor Shokin, the top Ukrainian prosecutor, whom the United States viewed as ineffective and beholden to Poroshenko and Ukraine’s corrupt oligarchs. In particular, Shokin had failed to pursue an investigation of the founder of Burisma, Mykola Zlochevsky.

The U.S. Embassy in Kyiv proposed that Biden, during his 2015 visit there, use a pending delivery of $1 billion of loan guarantees as leverage to force reform. Biden addressed the Ukrainian parliament, decrying the “cancer of corruption” in the country and criticizing the prosecutor’s office. During that visit, Biden privately told Poroshenko the loan guarantees would be withheld unless Shokin was replaced. After repeated calls and meetings between the two men over several months, Shokin was removed and the loan guarantees were provided.

What’s the biggest scandal of the week? Is it that: (a) U.S. spy agencies have warned that President Trump’s personal lawyer, Rudolph W. Giuliani, was promoting Russian disinformation to smear Joe Biden over his son’s business dealings in Ukraine? Or is it that: (b) Twitter and Facebook hesitated to act as a conduit for Giuliani’s wild charges? If you’re a partisan Republican, the answer is obviously (b). If you’re a normal, patriotic American, the answer should be (a).

Even if all the emails are true, they don’t establish a scandal. The very first line of the very first New York Post article was false: “Hunter Biden introduced his father, then-Vice President Joe Biden, to a top executive at a Ukrainian energy firm less than a year before the elder Biden pressured government officials in Ukraine into firing a prosecutor who was investigating the company, according to emails obtained by The Post.”

As TheWashington Post has repeatedly reported, the Ukrainian prosecutor, Viktor Shokin, was not investigating Burisma, the energy company on whose board Hunter Biden sat. Joe Biden demanded, on behalf of the U.S. government, that Shokin be fired precisely because he was complicit in corruption. Both the Biden campaign and Hunter Biden’s lawyer also deny that the meeting described ever took place. But even in knocking down these lies, the mainstream press gives them visibility — which is what Trump wants.

The right is simply wrong to claim it is the victim of “censorship” by social media companies — and the mainstream press should refrain from using that loaded and inaccurate term. The top nine links on Facebook on Thursday were all from right-wing sources — talk-radio host Dan Bongino, Fox “News,” Trump, Breitbart and Franklin Graham. But Facebook and Twitter are private-sector companies, and they have no obligation to pass along possible Russian disinformation. That’s not “censorship.” It’s editorial judgment, and it’s something we need more of online.

The story of Hunter Biden’s involvement with the Ukrainian gas company Burisma isn’t a scandal about his father, as the Trump campaign claims, but part of a personal tragedy for the vice president’s son, compounded by this week’s dissemination of what looks like disinformation about Joe Biden’s role.

What’s clear, beyond the false scandal-mongering, has been evident for years: Hunter Biden made a mistake getting involved with a dubious company like Burisma. But the notion that the Burisma affair undermines Joe Biden’s case to be president is, as he would say, malarkey.

This is smoke without a fire. Hunter Biden erred. His father has said so quietly but clearly. He should get on with the business of trying to put the country back together after Trump’s ruinous presidency.
