Quick: what do you do when you‘re the president of the United States, you’re about to lose your second chief of staff in less than two years, and no one wants to work for you because you’re an unhinged maniac who can’t be controlled and the best part of people’s days is when you don’t make it into the office? While the president seems to believe that his daughter and son-in-law are eminently qualified to work in the upper echelons of the U.S. government, here, as a reminder, is what the Boy Prince of New Jersey actually brings to the table:

A penchant for f--king up paperwork, having screwed up his financial disclosure form 39 times;

What we assume is a plaque emblazoned with the title “World’s Worst Real-Estate Developer,” having paid $1.8 billion for an aging Midtown skyscraper on the eve of the financial crisis (the family company, Kushner Cos., was finally able to offload the thing this summer, but that doesn’t change the fact that buying it was, as they say in the biz, “a dumb as s--t idea”);

The sort of delusional self-confidence that allows a person with literally no foreign-policy experience to think that he is going to be the one to bring peace to the Middle East;

Seemingly as many business conflicts of interest as his father-in-law;

The rotting carcass of a once-successful newspaper he ran into the ground;

An upcoming Congressional investigation into his close personal relationship with Crown Prince Mohammed bin Salman, who the C.I.A. says ordered the assassination of a U.S. resident.

Former CIA Director John Brennan went even further. “Now we're left with people who are yes men, whether it be a Mike Pompeo or John Bolton or others,” Brennan said on MSNBC, naming the national security adviser alongside the secretary of State. “These are individuals who have not demonstrated any backbone and spine in terms of standing up.”

Whitaker’s move came shortly after the House Judiciary Committee voted along party lines to give its chairman the authority to subpoena Whitaker’s testimony, should he not appear or answer lawmakers’ questions.


Whitaker’s stunt comes after months of delay and refusal to testify voluntarily, a bit of chutzpah that did not go unremarked upon by Democrats ("the panel had sent Whitaker many letters and requests to settle points of his testimony in advance, to which he had chosen not to respond”). No doubt, when Whitaker shows up on Friday he’ll invoke executive privilege (improperly, since that is not a privilege that holds up against Congress), necessitating the committee then to issue a subpoena and attempt to compel his testimony.

The real issue here is Whitaker’s fear of appearing and being forced to answer questions under threat of congressional contempt, which could occur if he is under subpoena. (“Democrats worry that Whitaker, whose public comments before taking over the Justice Department suggested that he was sympathetic to Trump and critical of the Mueller inquiry, may seek to evade questions he is asked during the proceedings.”)

“This is outrageous,” said constitutional scholar Larry Tribe. “Whitaker seems to think he is entitled to dictate the terms on which he is invited to testify. He is not. It is anti-constitutional for a member of the Article II branch, not to mention an unconfirmed acting officer whose initial appointment was of dubious legality, to insist that he will not appear to give testimony properly sought by the Article I branch, acting through a duly constituted committee of the U.S. House of Representatives, unless that Article I committee first sacrifice one of its statutory and constitutional prerogatives.”
