A violation of NSA's intellectual property?

Whoever the cretin/cretins who issued a cease and desist due to this moronic line of reasoning should be fired.

Most likely he/they will be promoted, the tee shirt maker will receive a large settlement, and we the people will receive the bill.

And the poor secretary who typed the letter will be out on her ass.

My experience regarding the interplay between the First Amendment and intellectual property law would lead me to conclude that the T-Shirt maker should prevail. His T-shirt is mostly expression, with a commercial benefit as a side effect.

The NSA is a government entity. Can they really have intellectual property that does not belong to the people?

For instance, SNL uses the presidential seal in many of it's skits. Is that a foul?
