The 9th circuit court may rule in its favour, but then it goes to our esteemed SCOTUS where Scalia and his buddies will vote it down.

True dat, as it was with the Civil Rights Act and the Voting Rights Act. The tendency for California to address controversial issues through referenda is where the problem lies. Remember Prop 13?

Representative government is supposed to protect us from the ignorance and herd mentality of the common man. Unfortunately, it seems that the GOP is trying to appeal to and capitalize upon the public's base instincts and herd mentality.

Yup, when the majority tends to interfere with the rights of the minority, that's when the court steps in. There is no rational basis for the STATE to interfere with the decisions of two adults to commit to one another solely on the basis of the gender of the adults. A church has the First Amendment right to determine whose union it will sanction, but the church's preference should not determine the civil law.

Strange that it was never an issue before. I guess all those great lib leaders all those years were evil too.

Guess we'll have to change the Constitution. Unless the court can find the Constitution unConstitutional!

The Constitution defines marriage? I don't recall reading that. But, I do recall these words, "..certain inaliable rights, principle among these the right to Life, Liberty, and the Pursuit of Happiness." How can people be free if the masses are forcing their religious beliefs on others? Which is what this boils down to; An attempt by the right to legislate their religious beliefs, something I personally regard as a step towards theocracy. A state endorsement of a specific religious dogma, also a clear constitutional violation.

Sorry, but I do and always will believe that there are times when the state MUST step in and protect a minority from the will of the masses in order to protect individual liberties. Without it there is no individual liberty.
