I'd have no problem as long as it was recognized that the primary weapon was microbes.

There were plenty enough more 'conventional' massacres. There was the Trail of Tears. Buffalo were exterminated in a frank and open effort to starve the plains tribes.

The convention, recall, calls out acts with "intent to destroy, in whole or in part."
