2. Yes.
Moral? Don't act as if you have a pistol. (He doesn't have to possess a pistol, you only have to reasonably believe that he might.)
That said, this guy was UBER squirrelly, well beyond what most of these sorts of things look like.
This particular incident was red flag from the pull over.
