Sounds like several people with badges need to be fired and the city needs to pay a big settlement for this to go away. The Third Amendment allegation is wishful thinking on the part of their attorney but what the hell? Nothing ventured......

There's been a trend to really militarize the police in the last 20-30 years (or longer) and it's gotten much worse since the Bill of Rights became essentially meaningless in October 2001 by an act of Congress. http://en.wikipedia.org/wiki/Patriot_Act

Nevada, Arizona and and New (Don't Clench) Mexico have been sh!tholes for years in terms of law enforcement, ime and opinion. I'll stay on the west bank of the Colorado river, thank you very much. Not that there's much to see east of the Colorado except for horned toads, scorpions and Gila Monsters anyway.

The 3rd Amendment bit was a bright idea to get the lawsuit into Federal court, I think. Cops probably wouldn't be this far gone without cover from local courts.

After reading the complaint, I see that they also alleged a Fourth Amendment violation which seems to be to be far more appropriate - indeed a slam dunk.

I've seen Cops fired for much less serious misconduct and the terminations upheld. The suggestion that union-represented cops are untouchable is a myth. Most officers would prefer to see this type of misconduct addressed and this type of stain removed from the profession.

Funny part is we had one of the county officers here last evening and he could not have been nicer. We were looking for someone with greater firepower than 6mm paintball pisto; to rid us of a rabid racoon.
