I guess you missed my point. Though Germany certainly has a significant measure of freedom of speech (as does the UK), freedom of speech is not held as sacred, nor embodied as deeply in their laws as it is in ours. For example, it is a civil offense subject to monetary penalty to insult someone (Beleidigung), even if only by hand gesture. Flipping somebody off can cost you up to 4,000 Euros and calling somebody an asshole can cost you 1,000 Euros.

Our freedom of speech extends to making dire threats, causing mortal fear. We are soooo fucking fortunate here with our freedoms to be threatened and shot at will.

What you got against free expression, eh TJ? You want somebody telling you what you can and cannot say in public? You want somebody telling you that you can't walk around with a poster like this...

Well there sure does appear to be some who are more than happy to have the government interfere with somebody else's free expression when they don't approve of it. And we have a few of them right here. The people of South Carolina's free expression...Pam Geller's free expression.
There's no half-way with this. We either want our free speech rights protected, or we don't.

I submit that the Free Speech guarantee does not apply to the display of symbol of armed rebellion against the United States Government.

I have to disagree with you on that. This should be covered under free speech, people of SC may even claim this to be a symbol of their heritage. Lindsay Graham did allude to this a day or two ago.
The TP flag is definitely a lot more provocative than Dixie flag and they are displayed all over their gatherings.

Not exactly.

The issue at hand was whether or not his Internet rant actually conveyed a lethal threat.

True, it's the United States of America, not the United States of ethical behavior.

The Gadsden (TP) Flag was a symbol of the American Revolution and used semi-officially by American "Continental" forces during the war. It has an honorable history which is being besmirched by the baggers.
