He was impeached so that covers charges. Also the way that it is written in the 14th amendment leaves out convicted IIRC. At the time it was passed they had just went through dealing with insurrection and saw the need to suspend this need be a good guess.
Not a lawyer and will defer to a more learned one.

The Colorado court got this issue right. The case is now likely headed to the US Supreme Court.

What's the worry? This is just a distraction. The POT will insure that Mango Man is the party's nominee anyway. These Republican primaries are just for show. It's like Putin claiming he won his election(s).

For the Republican Party of the MAGA sheeple?
For the party and its flag bearers it more than a distraction especially more states will disqualify Trump thus threatening his legitimacy as a candidate for the independent voters.

For the MAGA sheeple, one new grievance and another opportunity to shower their chieftain with $5 and $10 bills.

I am somewhat taken aback from this comment by Bill Barr, the previous AG.

Why is it legally wrong? Its their interpretation of the 14th Amendment which everyone agrees is quite confusing. By not acting on it, they would have in effect condoned Trump's insurrection.

Billy "Low" Barr has also stated that he would vote for "him" if he becomes the Repub nominee. Party before country. It's the Republican way.

From what I see this is how it shakes out.

Those who think the 14th amendment should not apply here:
Those who believe the election was stolen
Those who think tRump was justified in his actions
Those who wish him to be president again
